Privacy Policy

Privacy Policy

Personal data (hereinafter mostly referred to as “data”) is processed by us only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.

According to Art. 4, No. 1 of Regulation (EU) 2016/679, the General Data Protection Regulation (hereinafter referred to as “GDPR”), “processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

With the following privacy policy, we inform you in particular about the type, scope, purpose, duration, and legal basis of the processing of personal data, insofar as we decide, either alone or jointly with others, on the purposes and means of the processing. In addition, we inform you about the third-party components we use for optimization purposes and to increase the quality of use, insofar as this results in data being processed by third parties on their own responsibility.

Our privacy policy is structured as follows:

I. Information About Us as the Controller
II. Rights of Users and Data Subjects
III. Information on Data Processing

I. Information About Us as the Controller
The controller for this website in the sense of data protection law is:

LOVEFUL
Markstr. 408
44795 Bochum
Germany

Phone: 0234 79699421
Email: info@loveful.de

The data protection officer for the provider is:

Aydan Terzi

II. Rights of Users and Data Subjects
With regard to the data processing described in more detail below, users and data subjects have the right to:

Obtain confirmation as to whether or not data concerning them is being processed, and where that is the case, access to the personal data and further information about the data processing, as well as copies of the data (cf. also Art. 15 GDPR);

Obtain without undue delay the rectification of inaccurate personal data or to have incomplete personal data completed (cf. also Art. 16 GDPR);

Obtain the erasure of personal data concerning them without undue delay (cf. also Art. 17 GDPR), or, alternatively, where further processing is necessary according to Art. 17 (3) GDPR, to obtain a restriction of processing in accordance with Art. 18 GDPR;

Receive the personal data concerning them, which they have provided to us, in a structured, commonly used, and machine-readable format, and to transmit those data to another controller (cf. also Art. 20 GDPR);

Lodge a complaint with a supervisory authority if they consider that the processing of personal data relating to them by the provider violates data protection regulations (cf. also Art. 77 GDPR).

In addition, the provider is obliged to inform all recipients to whom data has been disclosed of any rectification or erasure of data or restriction of processing carried out pursuant to Articles 16, 17(1), and 18 GDPR. However, this obligation does not apply if this communication is impossible or involves a disproportionate effort. Without prejudice to this, the user has the right to be informed about these recipients.

Users and data subjects also have the right to object to the future processing of their data in accordance with Art. 21 GDPR, provided that the data is processed by the provider in accordance with Art. 6 (1) lit. f) GDPR. In particular, an objection to data processing for the purpose of direct marketing is permissible.

III. Information on Data Processing
The data processed by us when you use our website will be deleted or blocked as soon as the purpose of the storage ceases to apply, no legal retention obligations prevent the deletion of the data, and no other information about individual processing procedures is made below.

Server Data
For technical reasons, in particular to ensure a secure and stable website, data is transmitted from your internet browser to us or to our webspace provider. This so-called server log file includes the type and version of your internet browser, the operating system, the website from which you came to our website (referrer URL), the website(s) of our website that you visit, the date and time of the respective access, and the IP address of the internet connection from which the use of our website takes place.

This collected data is temporarily stored, but not together with other data from you.

This storage is based on the legal basis of Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.

The data will be deleted after seven days at the latest, unless further storage is required for evidence purposes. Otherwise, the data is completely or partially exempt from deletion until a final clarification of an incident.

Cookies
a) Session Cookies
We use so-called cookies on our website. Cookies are small text files or other storage technologies that are stored on your device by the internet browser you use. These cookies process certain information from you, such as your browser or location data or your IP address, to an individual extent.

This processing makes our website more user-friendly, effective, and secure, as the processing enables, for example, the display of our website in different languages or the provision of a shopping cart function.

The legal basis for this processing is Art. 6 (1) lit. b.) GDPR, if these cookies process data for the purpose of initiating a contract or for the performance of a contract.

If the processing is not for the purpose of initiating or performing a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6 (1) lit. f) GDPR.

These session cookies are deleted when you close your internet browser.

b) Third-Party Cookies
Our website may also use cookies from partner companies with whom we cooperate for the purposes of advertising, analysis, or the functionality of our website.

For details on this, in particular on the purposes and legal bases for the processing of such third-party cookies, please refer to the information below.

c) Option to Prevent
You can prevent or restrict the installation of cookies by making a setting in your internet browser. You can also delete cookies that have already been saved at any time. However, the necessary steps and measures for this depend on the specific internet browser you use. If you have questions, please use the help function or documentation of your internet browser or contact its manufacturer or support. For so-called Flash cookies, however, processing cannot be prevented via the browser settings. Instead, you must change the settings of your Flash player. The necessary steps and measures for this also depend on the specific Flash player you use. If you have questions, please use the help function or documentation of your Flash player or contact the manufacturer or user support.

If you prevent or restrict the installation of cookies, this may result in not all functions of our website being fully usable.

Contract Processing
The data you provide to us for the purpose of using our goods and/or services will be processed by us for the purpose of contract execution and is necessary for this. The conclusion and execution of a contract are not possible without providing your data.

The legal basis for the processing is Art. 6 (1) lit. b) GDPR.

We delete the data upon completion of the contract but must observe tax and commercial law retention periods.

As part of contract execution, we pass on your data to the transport company commissioned with the delivery of the goods or to the financial service provider, as far as the transfer is necessary for the delivery of the goods or for payment purposes.

The legal basis for the transfer of the data is then Art. 6 (1) lit. b) GDPR.

Customer Account / Registration Function
If you create a customer account with us through our website, we will collect and store the data you entered during registration (e.g., your name, address, or email address) exclusively for pre-contractual services, for the performance of the contract, or for the purpose of customer care (e.g., to provide you with an overview of your previous orders with us or to offer you the so-called notepad function). At the same time, we will store the IP address and the date and time of your registration. Of course, this data will not be passed on to third parties.

During the further registration process, your consent to this processing will be obtained and reference will be made to this privacy policy. The data collected by us is used exclusively for the provision of the customer account.

If you consent to this processing, Art. 6 (1) lit. a) GDPR is the legal basis for the processing.

If the opening of the customer account also serves pre-contractual measures or the performance of a contract, the legal basis for this processing is also Art. 6 (1) lit. b) GDPR.

You can revoke the consent you have given us to open and maintain the customer account at any time with effect for the future in accordance with Art. 7 (3) GDPR. To do this, you only have to inform us of your revocation.

The data collected in this regard will be deleted as soon as the processing is no longer necessary. However, we must observe tax and commercial law retention periods.

Credit Check and Scoring
If we offer you the possibility of paying by invoice as part of our goods or services and you make use of this, we reserve the right to obtain a credit report from a credit agency (such as Creditreform, Schufa, Bürgel, or infoscore) on the basis of mathematical-statistical procedures. For this purpose, we will forward your data, insofar as it is relevant to the contract, such as your name and address, to the credit agency. We use the subsequent information about the statistical probability of a payment default for our decision as to whether we offer you payment by invoice.

The legal basis for this processing is our legitimate interest in the payment security of the claim in accordance with Art. 6 (1) lit. f) GDPR.

Newsletter
If you sign up for our free newsletter, the data requested from you for this purpose, namely your email address and – optionally – your name and address, will be transmitted to us. At the same time, we store the IP address of the internet connection from which you access our website as well as the date and time of your registration. As part of the further registration process, we will obtain your consent to the sending of the newsletter, specifically describe the content, and refer to this privacy policy. We use the data collected for the newsletter dispatch exclusively – it will therefore not be passed on to third parties in particular.

The legal basis for this is Art. 6 (1) lit. a) GDPR.

You can revoke your consent to the newsletter dispatch at any time with effect for the future in accordance with Art. 7 (3) GDPR. To do this, you only have to inform us of your revocation or click the unsubscribe link contained in every newsletter.

Contact Inquiries / Contact Options
If you contact us via a contact form or email, the data you provide will be used to process your request. Providing the data is necessary to process and answer your request – without providing it, we cannot or can only partially answer your request.

The legal basis for this processing is Art. 6 (1) lit. b) GDPR.

Your data will be deleted as soon as your request has been answered conclusively and no legal retention obligations, such as for a subsequent contract execution, prevent the deletion.

User Contributions, Comments, and Reviews
We offer you the opportunity to publish questions, answers, opinions, or reviews, hereinafter referred to as “contributions,” on our website. If you make use of this offer, we process and publish your contribution, the date and time of submission, and the pseudonym you may have used.

The legal basis for this is Art. 6 (1) lit. a) GDPR. You can revoke your consent at any time with effect for the future in accordance with Art. 7 (3) GDPR. To do this, you only have to inform us of your revocation.

In addition, we also process your IP and email address. The IP address is processed because we have a legitimate interest in initiating or supporting further steps if your contribution infringes the rights of third parties and/or is otherwise unlawful.

The legal basis in this case is Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the, if necessary, legal defense.

Google Analytics
We use Google Analytics on our website. This is a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google.”

Through its certification under the EU-US Privacy Shield

https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

Google guarantees that the EU data protection requirements are also complied with when processing data in the USA.

The Google Analytics service is used to analyze the usage behavior of our website. The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

Usage-related and user-related information, such as IP address, location, time, or frequency of visiting our website, is transmitted to a Google server in the USA and stored there. However, we use Google Analytics with the so-called anonymization function. This function shortens the IP address already within the EU or the EEA.

The data collected in this way is in turn used by Google to provide us with an evaluation of the visit to our website and the usage activities there. This data can also be used to provide further services related to the use of our website and the use of the internet.

Google states that it does not link your IP address with other data. In addition, Google provides further data protection information for you at

https://www.google.com/intl/de/policies/privacy/partners

for example, on the options for preventing data use.

Google also offers a so-called deactivation add-on along with further information at

https://tools.google.com/dlpage/gaoptout?hl=de

This add-on can be installed with the common internet browsers and gives you more control over the data that Google collects when you visit our website. The add-on tells Google Analytics’ JavaScript (ga.js) that information about the visit to our website should not be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analysis services. You can, of course, also find out whether and which other web analysis services we use in this privacy policy.

Please note that if you delete the cookies in your browser settings, this may result in the opt-out cookie also being deleted and may have to be reactivated by you.

Google Maps
We use Google Maps on our website to display our location and to create directions. This is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google.”

Through its certification under the EU-US Privacy Shield

https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

Google guarantees that the EU data protection requirements are also complied with when processing data in the USA.

To enable the display of certain fonts on our website, a connection is established with the Google server in the USA when our website is accessed.

If you access the Google Maps component embedded in our website, Google stores a cookie on your device via your internet browser. To display our location and create directions, your user settings and data are processed. In this case, we cannot rule out that Google uses servers in the USA.

The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the optimization of the functionality of our website.

Due to the connection to Google established in this way, Google can determine from which website your request was sent and to which IP address the directions are to be transmitted.

If you do not agree to this processing, you have the option of preventing the installation of cookies by making the corresponding settings in your internet browser. Details on this can be found above under the section “Cookies.”

In addition, the use of Google Maps and the information obtained via Google Maps is governed by the Google Terms of Service https://policies.google.com/terms?gl=DE&hl=de and the Terms of Service for Google Maps https://www.google.com/intl/de_de/help/terms_maps.html.

Google Fonts
We use Google Fonts on our website to display external fonts.

The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the optimization and economic operation of our website.

Due to the connection to Google established when our website is accessed, Google can determine from which website your request was sent and to which IP address the display of the font is to be transmitted.

Google offers further information at

https://adssettings.google.com/authenticated

https://policies.google.com/privacy

and specifically on the options for preventing data use.

Google reCAPTCHA
To ensure sufficient data security when transmitting forms, we use the reCAPTCHA service of the company Google Inc. in certain cases. This serves primarily to distinguish whether the input is made by a natural person or is misused by machine and automated processing. The service includes sending the IP address and, if necessary, other data required by Google for the reCAPTCHA service to Google. The deviating data protection provisions of Google Inc. apply here. You can find more information on the data protection guidelines of Google Inc. at http://www.google.de/intl/de/privacy or https://www.google.com/intl/de/policies/privacy/

MailChimp – Newsletter
We offer you the opportunity to sign up for our free newsletters on our website.

For the newsletter dispatch, we use MailChimp, a service of The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318, USA, hereinafter referred to as “The Rocket Science Group.”

Through its certification under the EU-US Privacy Shield

https://www.privacyshield.gov/participant?id=a2zt0000000TO6hAAG&status=Active

http://mailchimp.com/legal/privacy/

If you sign up for our newsletter dispatch, the data requested during the registration process, such as your email address and, optionally, your name and address, will be processed by The Rocket Science Group. In addition, your IP address and the date and time of your registration will be stored. As part of the further registration process, your consent to the sending of the newsletter will be obtained, the content will be specifically described, and reference will be made to this privacy policy.

The newsletter subsequently sent via The Rocket Science Group also contains a so-called tracking pixel, also known as a web beacon. With the help of this tracking pixel, we can evaluate whether and when you have read our newsletter and whether you have followed any links contained in the newsletter. In addition to other technical data, such as the data of your computer system and your IP address, the data processed in the process is stored so that we can optimize our newsletter offer and cater to the wishes of the readers. The data is thus used to increase the quality and attractiveness of our newsletter offer.

The legal basis for the sending of the newsletter and the analysis is Art. 6 (1) lit. a.) GDPR.

You can revoke your consent to the newsletter dispatch at any time with effect for the future in accordance with Art. 7 (3) GDPR. To do this, you only have to inform us of your revocation or click the unsubscribe link contained in every newsletter.

Google AdWords with Conversion Tracking
We use the advertising component Google AdWords and the so-called conversion tracking on our website. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google.”

Through its certification under the EU-US Privacy Shield

https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active

Google guarantees that the EU data protection requirements are also complied with when processing data in the USA.

We use conversion tracking for targeted promotion of our offer. The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

If you click on an ad placed by Google, the conversion tracking we use stores a cookie on your device. These so-called conversion cookies lose their validity after 30 days and are otherwise not used for your personal identification.

If the cookie is still valid and you visit a certain page of our website, both we and Google can evaluate that you have clicked on one of our ads placed with Google and that you were then redirected to our website.

Through the information obtained in this way, Google creates a statistic for us about the visit to our website. We also receive information about the number of users who clicked on our ad(s) and about the pages of our website that were subsequently accessed. Neither we nor third parties who also use Google AdWords are able to identify you in this way.

You can also prevent or restrict the installation of cookies by making the corresponding settings in your internet browser. At the same time, you can delete cookies that have already been saved at any time. However, the necessary steps and measures for this depend on the specific internet browser you use. If you have questions, please use the help function or documentation of your internet browser or contact its manufacturer or support.

Furthermore, Google also offers further information on this topic at

https://services.google.com/sitestats/de.html

http://www.google.com/policies/technologies/ads/

http://www.google.de/policies/privacy/

and specifically on the options for preventing data use.

Google Remarketing or “Similar Audiences” Component from Google
We use the remarketing or “similar audiences” function on our website.

We use this function to place interest-based, personalized advertising on third-party websites that also participate in Google’s advertising network.

The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our website.

To enable this advertising service, Google stores a cookie with a sequence of numbers on your device via your internet browser during your visit to our website. This cookie anonymously records both your visit and the use of our website. However, personal data is not passed on. If you subsequently visit the website of a third party who in turn also uses Google’s advertising network, advertising might appear that relates to our website or our offers there.

For permanent deactivation of this function, Google offers a browser plug-in for the most common internet browsers via

https://www.google.com/settings/ads/plugin

The use of cookies from certain providers can also be deactivated, for example, via

http://www.youronlinechoices.com/uk/your-ad-choices

or

http://www.networkadvertising.org/choices/

by means of an opt-out.

Through so-called cross-device marketing, Google may also track your usage behavior across multiple devices, so that you may be shown interest-based, personalized advertising even if you switch devices. However, this requires that you have agreed to the linking of your browser histories with your existing Google account.

Google offers further information on Google Remarketing at

http://www.google.com/privacy/ads/
